The opinion of the court was delivered by This is an appeal in a criminal action in which Richard Lee McCarther (defendant-appellant) was convicted in the district court of Sedgwick County, Kansas, upon three counts charged in the information as follows: Count I, robbery in the first degree in violation of G.S. 1949 (now K.S.A.) 21-527; Count II, possessing and owning a firearm after conviction of felony in violation of G.S. 1961 Supp. (now K.S.A.) 21-2611; and Count III, felonious assault in violation of G.S. 1949 (now K.S.A.) 21-431. Upon conviction the appellant was sentenced to the Kansas State Penitentiary at Lansing where he is presently confined.
